The Application may include features for purchasing virtual products or services ("In-app
Purchases"). These In-app Purchases are subject to the terms and conditions of the application store
(e.g., Apple App Store or Google Play Store) from which you downloaded the Application. You
acknowledge and agree that all billing and transaction processes are handled by the application
store and governed by their terms and conditions.
When you create an account with Us ("Account"), you must provide Us information that is accurate,
complete, and current at all times. You are responsible for maintaining the confidentiality of your
Account and password, including but not limited to any activity that occurs under your Account. You
agree not to disclose your password to any third party. You must notify Us immediately upon becoming
aware of any breach of security or unauthorized use of your Account.
Our Service allows You to post content ("Content"). You
are responsible for the Content that You post to the Service, including its legality, reliability,
and appropriateness.
By posting Content to the Service, You grant Us the
right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such
Content on and through the Service. You retain ownership of your Content and are responsible for
protecting those rights.
The Company is not responsible for the content of the
Service's users. You agree to be solely responsible for the Content and for all activity that occurs
under your account. You may not transmit any Content that is unlawful, offensive, upsetting,
intended to disgust, threatening, libelous, defamatory, obscene or otherwise objectionable. The
Company reserves the right, but not the obligation, to remove any Content that it deems, in its sole
discretion, to be inappropriate and in violation of these Terms.
The Company performs regular backups of Content, but
does not guarantee there will be no loss or corruption of data. You agree to maintain a complete and
accurate copy of any Content in a location independent of the Service.
The Company respects the intellectual property rights of
others. We respond to claims of copyright infringement on the Service. If you believe that your
copyright has been infringed, please follow the procedures outlined in our DMCA Notice and DMCA
Procedure for Copyright Infringement Claims section below.
You assign all rights, title and interest in any
Feedback You provide the Company. The Company has a non-exclusive, perpetual, irrevocable, royalty
free, worldwide right and license to use such Feedback without restriction.
Our Service may contain links to third-party web sites
or services that are not owned or controlled by the Company. The Company has no control over, and
assumes no responsibility for, the content, privacy policies, or practices of any third party web
sites or services.
We may terminate or suspend your Account immediately,
without prior notice or liability, for any reason whatsoever, including without limitation if you
breach these Terms. Upon termination, your right to use the Service will cease immediately.
To the maximum extent permitted by applicable law, the
Company shall not be liable for any special, incidental, indirect, or consequential damages
whatsoever. Our liability, and the liability of our suppliers and licensors, in any case is limited
to the greater of the amount you paid to use the Service or USD $100.00. Some states do not allow
the exclusion of implied warranties or limitation of liability for incidental or consequential
damages, which means that some of the above limitations may not apply to you.
